FAILED TO DISQUALIFY APPOINTMENT OF TOMMY THOMAS' LAWYERS IN RM 1.9MIL SUIT - NAJIB RAZAK
KUALA LUMPUR, MALAYSIA: The High Court here has dismissed Datuk Seri Najib Razak's application to disqualify the appointment of two (2) lawyers from Messrs Tommy Thomas to represent former attorney general Tan Sri Tommy Thomas in a RM 1.9mil suit field by the former prime minister.
Judge Justice Ahmad Bache, in his broad grounds, said it is trite particularly in common law and in practice, that a litigant has the right to choose a solicitor of his own choice.
He said current Attorney General Tan Sri Idrus Harun has given both counsel - Alan Adrian Gomez and Mervyn Lai Wei Shiung - the consent of fiat on July 29, 2022 to represent Thomas even though he (Thomas) was sued in his capacity as a government officer at the time, which ordinarily will be represented by the senior federal counsel from the Attorney General's Chambers (AGC).
" The present AG must have considered all the requirements expected of the two (2) counsel representing Thomas, before granting the consent of fiat, including their ability to act professionally and in the best interest of the administration of justice," he said during an online proceeding.
Najib, in his application to disqualify the two (2) lawyers, questioned whether the duo would be able to maintain their professional independence and act objectively in the suit field on October 22, 2022 for a declaration that Thomas had committed misfeasance in public office over criminal charges brought against him.
The Pekan MP, who named Thomas and the government as the first and second defendants respectively, claimed that the charges against him were part of a move that had been planned in advance by Thomas and it was also in line with the Pakatan Harapan government's plan at the time.
Thomas, who resigned as AG on February 28, 2020 was a founder and consultant or partner of the legal firm, while his partners also had financial interest in the firm.
On the argument there was a personal and pecuniary interest involved between the two (2) counsel and the firm, Justice Ahmad ruled they have no nexus with the dispute between Najib and Thomas.
" It was not even satisfactorily established or proved of the personal and pecuniary interest in Najib's supporting affidavit.
" From the affidavit in reply by the defendants, it was affirmed that neither the two (2) counsel nor the other partners or associates of the firm were involved in the prosecution of the plaintiff, hence, it is very unlikely that they will be witnesses," said the judge.
Justice Ahmad said even though Thomas was the founder of the firm, he is no longer a partner and in fact, was just a consultant who does not enjoy any profit as he did not have any shares in the firm.
" He (Thomas) does not even have a practising certificate which was cancelled following his appointment as the Attorney General. Hence, there is no pecuniary interest between the firm and Thomas.
" The court observed there was no similar objection raised by Najib in another suit filed by him (Najib) against Thomas in the Shah Alam High Court; it is clear that Najib is taking an inconsistent position and is estopped now from making this application at this juncture, " he said.
He added there will be no prejudice against Najib as the conduct of the two (2) counsel will be strictly supervised by the court, hence the court should not readily accede to the application to nullify the appointment of the duo.
He said there is no convincing evidence to show that the two counsel will not be able to maintain professional independence and to act objectively and in the best interest of the administration of justice.
" The application to disqualify the two (2) counsel from Messrs Tommy Thomas to represent Thomas is dismissed with costs of RM 3,000," said the judge and fixed September 09, 2022 to hear the defendant's application to strike out Najib's suit.

Bekas Perdana Menteri itu mendakwa, permohonannya untuk memasukkan bukti tentang kedudukan Mohd Nazlan dalam Kumpulan Maybank sebelum ini, sememangnya mempunyai konflik kepentingan yang cukup besar.
" Saya terkejut. Saya kecewa dengan keputusan mahkamah yang tidka membenarkan saya memasukkan bukti baharu yang saya sesungguhnya percaya hakim Mohd Nazlan mempunyai konflik kepentingan yang tinggi.
" Beliau pastinya mempunyai pengetahuan peribadi yang dalam tentang semua transaksi berkaitan dana 1MDB dan juga SRC, selain penyiasatan berkaitan penglibatan beliau dalam Maybank oleh SPRM," katanya kepada media di lobi Istana Kehakiman pada 16 Ogos 2022 (Selasa).
Mohd Nazlan adalah Hakim Mahkamah Tinggi (kini Hakim Mahkamah Rayuan) yang mendapati Najib bersalah terhadap tujuh (7) tuduhan pecah amanah, menyalahgunakan kuasa dan pengubahan wang haram dana SRC dan memeritahkannya dipenjara selama 12 tahun serta didenda RM 210 juta pada 28 Julai 2020.
Terdahulu, panel lima (5) hakim Mahkamah Persekutuan menolak pasukan pembelaan Najib untuk memasukkan bukti tambahan yang dikatakan bukti baharu yang membabitkan kedudukan Mohd Nazlan dalam Kumpulan Maybank, sebelum rayuan terakhir kes penyelewangan dana RM 42 juta milik SRC International yang dihadapi bekas Presiden UMNO itu.
Panel yang dipengerusikan oleh Ketua Hakim Negara, Tun Tengku Maimun Tuan Mat turut menolak permohonan Najib untuk menangguhkan prosiding akhir rayuannya antara tiga (3) hingga empat (4) bulan bagi membolehkan barisan peguam baharu yang dilantik itu bersedia dengan hujahan lebih baik.
Sementara itu juga, Najib tetap bersemangat untuk terus melawan semua pertuduhan yang disabitkan terhadapnya walaupun selepas permohonan memasukkan bukti baharu dan penangguhan prosiding rayuan ditolak oleh Mahkamah Persekutuan.
Mahkamah kemudian menetapkan prosiding rayuan akhir itu bermula pada 18 Ogos 2022 (Khamis).
Tengku Maimun dalam keputusan menolak penangguhan itu, berkata Najib mengetahui tarikh prosiding rayuan akhir, tetapi memilih untuk melantik peguam baharu mewakilinya.
Beliau berkata lagi, walaupun itu adalah haknya untuk memilih tetapi Najib kemudian tidak boleh menyatakan bahawa peguamnya tidak bersedia dengan rayuan terakhir.
Terdahulu, Najib menerusi peguam utamanya, Hisyam Teh Poh Teik memohon mahkamah menangguhkan prosiding rayuan akhir kes itu.
Hisyam yang baru dilantik pada 21 Julai 2022, memohon budi bicara mahkamah untuk menangguhkan prosiding rayuan akhir, sejurus mahkamah menolak permohonannya untuk memasukkan bukti tambahan berhubung peranan Hakim Datuk Mohd Nazlan Mohd Ghazali.
Katanya, rayuan akhir itu membabitkan dokumen yang banyak iaitu sebanyak 179 jilid dan keterangan saksi yang ramai.
Hisyam memohon agar rayuan utama ditangguhkan sekurang-kurangnya tiga (3) hingga empat (4) bulan kerana pelantikannya sebagai peguam utama hanya dibuat baru-baru ini.
Timbalan Pendakwa Raya Kanan, Datuk V Sithambaram, pula memaklumkan bahawa pihaknya menyerahkan kepada budi bicara mahkamah untuk membuat keputusan adil.

19 STUDENTS TRAPED IN A LIFT IN KOTA DAMANSARA
19 private college students in Kota Damansara can count their lucky stars as they escaped a malfunctioned lift without any injury.
In a Facebook posting on August 14, 2022 (Sunday), the Sungai Buloh Fire and Rescue Department shared a video of a rescue operation which occured on Saturday - to remind the public, not to overload when riding in a lift.
Inside the video viral, one of the firefighters can be heard communicating to a person, who is believed to be in charge of the students, asking her at what level is the lift stuck in.
Another firefighter can be seen opening the out-of-order lift's door with a key before helping the trapped college students - all females - get out of the lift that was stuck between the first and ground floor.
One of the victims almost loses her consciousness due to the incident.
" Excessive loads will cause the lift to malfunction even if the overload warning sound was not emitted.
" It is advisable to be patient and to use the lift properly to avoid any unwarranted mishaps from taking place," the Sungai Buloh Fire and Rescue Department wrote in its posting.
They also warned the public that it is possible for victims that were trapped in a lift to suffocate and lose their consciousness due to the heat and lack of oxygen.
Responding to the incidents, netizens were baffled at the poor decision-making of the victims but applauds the department's swift action in saving them.

INVESTED $500 M IN RUSSIAN FIRMS' AS UKRAINE WAR LAUNCHED - SAUDI ARABIA'S ALWALEED BIN TALAL
Alwaleed bin Talal, a billionaire Saudi Prince, invested more than $500m in Russian firms during the same month Moscow began its invasion of Ukraine.
Stock exchange filings seen by Bloomberg News Alwaleed's Kingdom Holding Co in February 2022 acquired shared in Gazprom, Lukoil and Rosneft.
Kingdom Holding invested 1.37bn riyals ($365m) in Gazprom's American depositary receipts in February 2022. Between February and March 2022, it invested $52m in Rosneft's global depositary receipts and $109m in Lukoil's American depositary receipts.
The filings did not show when Talal's company made the specific investments, but after the war in Ukraine began on 24 February the Saudi prince's investments in these companies dropped rapidly in value.
But the filings did show that Kingdom Holding had invested $3.4bn in global equities and depositary receipts since 2020.
Earlier this year, Alwaleed sold 625 million shares, or 16.87 percent, of his Kingdom Holding Co, worth approximately $1.5bn, according to official Saudi records, to the Saudi sovereign wealth fund.
Alwaleed's grandfather, Abdulaziz, founded Saudi Arabia. He is one of the wealthiest men in the kingdom and known internationally for being a major investor, including in firms such as Twitter and Uber.
In 2017, the 67-year-old billionaire was among hundreds of Saudi princes and businesspeople imprisoned by Saudi Crown Prince Mohammed bin Salman in Riyadh's Ritz Carlton hotel and forced to hand over vast sums of cash in what authorities described as an anti-corruption drive.
After three (3) months, a gaunt Alwaleed was released, declaring his detention a misunderstanding. It is reported that he gave the authorities billions in return for his freedom.
Alwaleed recently had a back and forth with Tesla and Space X CEO Elon Musk over the latter's bid to buy Twitter.
The Saudi Prince was one of the few investors who spoke out against Musk's takeover and said it did not reflect Twitter's intrinsic value...given its growth prospects."
But in late May 2022, Alwaleed tracked back on his comment and agreed to contribute 35 million Twitter shares, worth $1.9bn, to retain a stake in the company post-acquisition.

NAJIB SET TO BEGIN JAIL SENTENCES - FINAL SRC APPEAL
PUTRAJAYA, MALAYSIA : The Federal Court has affirmed the conviction and sentence faced by former prime minister Datuk Seri Najib Razak in the SRC International Sdn Bhd Case.
Chief Justice Tengku Maimun Tuan Mat, in the broad grounds of judgement, said the five-judge panel had examined the merits of the case " In Great Detail".
She said the apex court found that the conviction was safe on all seven charges and that the sentence was not excessive. She ordered that he be sent to jail immediately.
Najib had been sentenced by the High Court to 12 years in jail and fined RM 210mil for seven (7) charges of criminal breach of trust, money laundering and abuse of power involving RM 42mil from SRC's funds.
" These appeals are therefore unanimously dismissed and the conviction and sentence are affirmed.
I pronounce the warrant of committal," the CJ said.
Najib's lead counsel Hisyam Teh Poh Teik had stood up to request for a stay of execution pending a review application on the decision.
This was denied by the court.
" There is no legal provision for that. Court is adjourned," the CJ responded before leaving the courtroom Tuesday, August 23, 2022.
Other judges on the bench are Chief Judge of Sabah and Sarawak Justice Abang Iskandar Abang Hashim and Federal Court judges Nallini Pathmanathan, Mary Lim Thiam Suan and Mohamad Zabidin Mohd Diah.
Earlier, in the decision, the CJ touched on the defence's refusal to submit on the 94 grounds of appeal.
She said the panel had asked Hisyam repeatedly on whether he would want to submit but the counsel took the position that he would not.
" In the circumstances, we cannot but conclude from the above facts that the counsel, having been given every opportunity to make submissions on the merits of the appeals, refused to do so," she said.
In the absense of the submissions, the panel focused on the 94 grounds of appeal in the petition of appeal filed by Najib.
The CJ said Najib's complaints were essentially on two main issues:
1- That the Court of Appeal errer in fact and in law by finding that the High Court judge had correctly found that the prosecution had made out a prima facie case on all seven charges.
2- That the Court of Appeal errer in fact and in law by finding that the High Court judge had correctly appreciated the defence and that it was argued that the defence managed to raise a reasonable doubt on all seven charges.
The apex court, however, said that the trial judge was correct when he held that all the ingredients of the seven charges were established at the close of the prosecution's case.
" The appellant was thus rightly called upon to enter his defence on all the seven charges.
" In the circumstances, we fail to see how and where any of the learned trial judge's findings leading to the ultimate finding that a prima facie case had been made out, are perverse," the CJ said.
The Federal Court also found that the findings of the High Court on the defence were correct.
" In concluding that the defence failed to raise a reasonable doubt on the prosecution's case, we find that the learned High Court judge had undertaken a thorough analysis of the evidence produced by the defence.
" Thus, we are unable to conclude that any of the findings of the High Court, as affirmed by the Court of Appeal were perverse or plainly wrong so as to warrant appellate interventation.
" We agree that the defence is so inherently inconsistent and incredible that it does not raise a reasonable doubt on the prosecution case," she said.
After the proceedings adjourned, Najib's family was seen sitting with him in the dock.
His wife Datin Seri Rosmah Mansor, sons Mohd Nizar and Norashman and daughter Nooryana Najwa were with him in the dock.

BEKAS PEGAWAI TERTINGGI TENTERA AKAN DIDAKWA 16 OGOS 2022 MENGENAI ISU LCS
KUALA LUMPUR MALAYSIA :Seorang bekas pengarah urusan sebuah syarikat perkapalan dan juga merupakan bekas pegawai tertinggi tentera dijangka dihadapkan ke Mahkamah Seksyen pada 16 Ogos 2022 (Selasa), berhubungnya projek Kapal Tempur Pesisir (LCS) milik Tentera Laut Diraja Mlaaysia (TLDM).
Lelaki yang berusia hampir 80 tahun itu akan didakwa atas tiga (3) pertuduhan membabitkan kesalahan pecah amanah mengikut Seksyen 409 Kanun Keseksaan.
Difahamkan juga, lelaki itu akan dibawa ke Kompleks Mahkamah Kuala Lumpur pada jam 0900 pagi dan berdasarkan semakan di sistem mahkamah kes itu akan didengar di hadapan Hakim Suzana Hussin.
Terdahulu, pendedahan laporan PAC bahawa LCS tercanggih pertama milik TLDM yang pernah dilancarkan pada tahun 2017 dlaam keadaan tidak siap, mengejutkan banyak pihak.
Projek pembinaan LCS adalah perolehan terbesar dalam sejarah Kementerian Pertahanan Malaysia dengan kos keseluruhan sebanyak RM 9 bilion ringgit.
Kontrak bagi projek itu bermula pada tahun 2013 dan dijangka siap dalam masa 10 tahun berikutnya iaitu siap pada tahun 2023.
PAC dalam laporannya menyatakan, kerajaan sudahpun membayar RM 6.083 bilion untuk projek lima (5) kapal LCS kepada Boustead Naval Shipyard Sdn Bhd (BNS) yang dilaksanakan secara runding terus namun tiada kapal yang diterima setakat ini.
Memetik pada kenyataan Pengerusi PAC, Wong Kah Woh, mendedahkan lebihan kos projek LCS berjumlah RM 1.4 bilion dengan kos RM 400 juta digunakan bagi tujuan untuk membayar hutang lama daripada projek kapal peronda lama.

SHIRTLESS MAN AND FRIEND ASSAULTS USTAZ AND TAHFIZ STUDENT IN KUALA LIPIS, PAHANG DARUL MAKMUR
Two (2) of the five (5) men suspected of ' attacking ' a tahriz centre - beating the teacher and students - were successfully arrested by the police.
Lipis district police chief Superintendent Azli Mohd Noor said the two (2) suspects in their 30s were arrested in several raids around Damak in Jerantut, Saturday, August 13, 2022.
Both suspects were remanded for four (4) days starting on Saturday, August 13, 2022 and the case is being investigated under Section 147 of the Penal Code for rioting and Section 448 of the Penal Code for trespassing.
Three (3) more suspects are still being traced including a main suspect, whose personal details have been identified and efforts to arrest the suspect are being intensified.
Lipis district police chief Superintendent Azli Mohd Noor on the case's progress.
He said the two (2) arrested suspects tested positive for methamphetamine and were also investigated under Section 15 (1) (a) of the Dangerous Drugs Act 1952.

It is believed that the suspect was not satisfied with the tahfiz centre over food charges.
Based on preliminary information, five (5) men and a student went to the tahfiz centre in a four (4)-wheel drive before three (3) suspects attacked the victim.
In that incident, the tahfiz caretaker was injured in his right eye and received four (4) stitches, an injury to his hand and bruises on his body.
Meanwhile, the student also sustained injuries to his body.
Video clips showing the attack had went viral on social media.
In one video lasting 2.51 minutes, a man wearing shorts scolded a victim before hitting him.
VIOLENCE IN BROAD DAYLIGHT !
Based on the recording, the man wearing the shoes expressed his displeasure when his nephew and other students were beaten.
The man then hit the victim before challenging him to fight.
The incident happened in front of other tahfiz students who were visibly shaken and unable to help.
The assault drew an angry response from netizens who called for justice.

MEE can reveal Palestinian group has 'considerable anger' towards Egyptian intelligence service over role played by Cairo in the hours before Israel bombed Gaza.
Four hours before Israel began bombing the Gaza Strip on Friday, August 12, 2022, Egyptian mediators told the Palestinian Islamic Jihad movement that Israel was not looking for an escalation, and would respond " positively " to a request to release two PIJ members from prison. An Israeli cabinet meeting to be held on the Sunday would announce this as a breakthrough in negotiations, the movement was reportedly told.
The assurance were conveyed to a senior member of the PIJ's political bureau by Egyptian mediator Brigadier Ahmed Abdul Khaliq at noon on Friday local time, four hours and twenty minutes (4hrs 20m) before the first Israeli air strike struck the Gaza Strip, sources close to the PIJ told Middle East Eye.
In the first detailed account of the negotiation that preceded Israel's latest offensive on Gaza, MEE can reveal there is now "considerable anger" towards Egyptian intelligence services from the PIJ over the role played by Cairo in the hours before Israel launched its most recent bombing campaign.
"[The PIJ] believe they have been betrayed by the Egyptians and that they were part of the game - to make them feel relaxed and secure just before the air strikes took place," a senior Palestinian source close to the PIJ told MEE.
" There is a lot of anger and tension within Islamic Jihad because of the role of [the] Egyptian mediation, because they consider the Egyptians gave them misleading information and hints just before the air strikes. As a result of this information, the Islamic Jihad relaxed and was unprepared for the air strikes."
Sources close to the PIJ told MEE that Abdul Khaliq incorrectly told Khaled al-Batsh, a senior member of the PIJ's political bureau, that there had been a "breakthrough" in indirect negotiations.
Israeli intelligence agents reportedly passed the following message to the PIJ through Egyptian intelligence: "We want to end this escalation. Give us until Sunday and we are pushing them [Israel's political leaders] to agree."
WHAT TRIGGERED THE UNREST?
Tensions escalated early last week when Israeli forces arrested Bassman al-Saadi, a senior PIJ commaneder, in the occupied West Bank.
Saadi was arrested following an Israeli raid in the city of Jenin, during which a Palestinian teenager was killed.
" When the Sheikh [Saadi] was arrested, there was some discussion in Gaza over whether to retaliate. The way he was arrested was humiliating, so that generated some anger. Immediately [the] Egyptians tried to calm the situation," one source with knowledge of the negotiation told MEE.
" The man doing that was the brigadier. He conveyed messages that the Shin Bet [Israel's internal intelligence agency] was not interested in escalation."
According to one source close the the PIJ, the movement asked Egyptian intelligence, and later obtained, filmed assurances of Saadi's physical wellbeing.
" This was taken as a good sign," the PIJ source said.
The PIJ then demanded the release of both Saadi and PIJ prisoner Khalil Awawdha, who has refused food for more than 150 days in a bid do draw attention to his detention by Israel without trial or charge.
Egyptian intelligence had told the PIJ that Shin Bet was "dealing positively" with the requests, and that they were very keen to ease tensions. They also said they were pushing the Israeli cabinet for the release of the two men.
QATAR'S ROLE PLATFORMED
But on Friday, August 12, 2022 Abdul Khaliq - who runs Egypt's General Intelligence Directorate unit, which is in charge of negotiations between Gaza-based Palestinian factions and Israeli intelligence, and who routinely chairs delegations from Hamas and the PIJ in Cairo - told Batsh of a breakthrough, which would be announced at the usual Israeli cabinet meeting on Sunday.
Then, just four hours later, Israel began bombing the Gaza Strip, killing Taiseer al-Jabari, the commander of the northern division of al-Quds Brigades (Saraya al-Qurds), the military wing of the PIJ, along with at least nine others, including a five-year-old girl.
As the air strikes rained down on Gaza or a second day, Khaled Mansour, a PIJ leader in southern Gaza, was targeted and killed in an Israeli air strike. Mansour had been a delegate at PIJ talks in Cairo.
The Israeli military said on Saturday that it had arrested at least 19 members of the PIJ in the occupied West Bank. The targeted air strikes and string of arrests have ruptured relations between the PIJ and Egyptian intelligence, with Ziad al-Nakhalah, the head of the PIJ, refusing to take calls from Egyptian intelligence, sources close to the PIJ told MEE.
The two sides had been previously very close, with the PIJ having mediated between Egyptian intelligence and Hamas.
The anger towards the Egyptians was made evident earlier this week when Nakhalah spoke at a press conference in the Iranian capital, Tehran.
Nakhalah praised the support he had received from Iran, Iraq and Qatari Foreign Minister Sheikh Mohammed bin Abdulrahman Al Thani, but notably failed to mention the role Egypt had played. He also thanked the Qatari-owned Al Jazeera media network for its rolling coverage of the assault on Gaza.
Egyptian reportedly protested, telling the PIJ they could not understand why Doha's role had been praised and Cairo's efforts to de-escalate tensions were overlooked.
RISK OF MORE VIOLENCE
Following a ceasefire brokered on Sunday by Egypt-with help from the United Nations and Qatar-the PIJ conveyed through Egyptian intelligence that they would stop rocket attack following Israel's reported pledge to release Saadi and Awawdah.
However, this was shattered when Israeli Defence Minister Benny Gantz ruled out Saadi's release.
"Saadi was justifiably arrested and I'm not familiar with a promise to release terrorists," Gantz told Israel's Channel 12 news.
" I don't want to simply promise they won't be released. We don't hold people in prison for nothing."
In an attempt to mend ties with the PIJ following Israel's offensive, Egypt has promised to send "a large delegation" to Israel to secure Awasdah's release.
The PIJ meanwhile is threatening to restart military action." The PIJ is threatening to go back to escalation if there is no progress," the source close to the PIJ told MEE.
MEE asked the Egyptian embassy in London and the Israeli military for comment but did not receive a response by time of publication.
